Trademarks & Copyrights

These guidelines are for 3B NEXUS licensees, authorized resellers, distributors, developers, customers, and other parties wishing to use 3B NEXUS’ trademarks, service marks or images in promotional, advertising, instructional, or reference materials, or on their web sites, products, labels, or packaging. Use of 3B NEXUS trademarks may be prohibited, unless expressly authorized.

If you are a licensee of a 3B NEXUS trademark or logo and have been provided with special trademark usage guidelines with your license agreement, please follow those guidelines. If your license agreement does not provide usage guidelines, then follow these guidelines. If you are a 3B NEXUS authorized reseller, an Agent or member of a 3B NEXUS program, you may be subject to additional restrictions.

3B NEXUS’ trademarks, service marks, trade names, and trade dress are valuable assets. In following these guidelines, you help us protect our valuable trademark rights and strengthen our corporate and brand identities. By using a 3B NEXUS trademark, in whole or in part, you are acknowledging that 3B NEXUS is the sole owner of the trademark and promising that you will not interfere with 3B NEXUS’ rights in the trademark, including challenging 3B NEXUS’ use, registration of, or application to register such trademark, alone or in combination with other words, anywhere in the world, and that you will not harm, misuse, or bring into disrepute any 3B NEXUS trademark.

The goodwill derived from using any part of a 3B NEXUS trademark exclusively inures to the benefit of and belongs to 3B NEXUS. Except for the limited right to use as expressly permitted under these Guidelines, no other rights of any kind are granted hereunder, by implication or otherwise. Authorized Use of 3B NEXUS Trademarks

1. Advertising, Promotional, and Sales Materials: Only 3B NEXUS and its authorized resellers, distributors, associates and licensees may use the 3B NEXUS logo in advertising, promotional, and sales materials. 3B NEXUS authorized resellers or Agents may use the 3B NEXUS Trademarks as specified in their Agreement and such use must always be in conjunction with the appropriate terms that define the relationship authorized by their contract with 3B NEXUS. For example:

1.3 Authorized Reseller

1.4 Authorized Value Added Reseller

1.5 Authorized Service Provider

2. Compatibility: Developers may use 3B NEXUS, or any other 3B NEXUS word mark (but not the 3B NEXUS logo or other 3B NEXUS-owned graphic symbol/logo) in a referential phrase on packaging or promotional/advertising materials to describe that the third party product is compatible with the referenced 3B NEXUS product or technology, provided they comply with the following requirements.

2.1 The 3B NEXUS word mark is not part of the product name.

2.2 The 3B NEXUS word mark is used in a referential phrase such as “runs on,” “for use with,” “for,” or “compatible with.”

2.3 The 3B NEXUS word mark appears less prominent than the product name.

2.4 The product is in fact compatible with, or otherwise works with, the referenced 3B NEXUS product.

2.5 The reference to 3B NEXUS does not create a sense of endorsement, sponsorship, or false association with 3B NEXUS or 3B NEXUS products or services.

2.6 The use does not show 3B NEXUS or its products in a false or derogatory light.

3. Publications, Seminars, and Conferences: You may use a 3B NEXUS word mark in connection with book titles, magazines, periodicals, seminars, or conferences provided you comply with the following requirements:

3.1 The use is referential and less prominent than the rest of the title. Acceptable: XYZ CONFERENCE for 3B NEXUS Users.

3.2 The use reflects favourably on both 3B NEXUS and 3B NEXUS products or technology.

3.3 Your name and logo appear more prominent than the 3B NEXUS word mark on all printed materials related to the publication, seminar or conference.

3.4 The 3B NEXUS logo or any other 3B NEXUS-owned graphic symbol, logo, icon or image does not appear on or in the publication or on any materials related to the publication, seminar, or conference without express written permission from 3B NEXUS.

3.5 A disclaimer of sponsorship, affiliation, or endorsement by 3B NEXUS, similar to the following, is included on the publication and on all related printed materials: “(Title) is an independent (publication) and has not been authorized, sponsored, or otherwise approved by 3B NEXUS Limited.”

3.6 A trademark attribution notice is included in the credit section giving notice of 3B NEXUS’ ownership of its trademark(s). Please refer to the section below titled “Proper Trademark Notice and Attribution.”

3.7 Websites: Websites that serve only as non-commercial electronic informational forums concerning a 3B NEXUS product or technology may use the appropriate 3B NEXUS word mark, provided such use complies with the guidelines set forth in Section 3 above.

Unauthorized Use of 3B NEXUS Trademarks

4. Company, Product, or Service Name: You may not use or register, in whole or in part, 3B NEXUS, Bulls Bears & Butterflies®, or any other 3B NEXUS trademark, including 3B NEXUS-owned graphic symbols, logos, icons, or an alteration thereof, as or as part of a company name, trade name, product name, or service name except as specifically noted in these guidelines.

5. 3B NEXUS Logo and 3B NEXUS-owned Graphic Symbols: You may not use the 3B NEXUS Logo or any other 3B NEXUS-owned graphic symbol, logo, or icon on or in connection with websites, products, packaging, manuals, promotional/advertising materials, or for any other purpose except pursuant to an express written trademark license from 3B NEXUS, such as a reseller, distributor or agent agreement.

6. Variations, Takeoffs or Abbreviations: You may not use an image of the real 3B NEXUS or other variation of the 3B NEXUS logo for any purpose. Third parties cannot use a variation, phonetic equivalent, foreign language equivalent, takeoff, or abbreviation of the 3B NEXUS trademark for any purpose.

7. Disparaging Manner: You may not use a 3B NEXUS trademark or any other 3B NEXUS-owned graphic symbol, logo, or icon in a disparaging manner.

8. Endorsement or Sponsorship: You may not use 3B NEXUS, or any other 3B NEXUS trademark, including 3B NEXUS-owned graphic symbols/logos, or icons, in a manner that would imply 3B NEXUS’ affiliation with or endorsement, sponsorship, or support of a third party product or service.

9. Merchandise Items: You may not manufacture, sell or give-away merchandise items, such as T-shirts and mugs, bearing 3B NEXUS or any other 3B NEXUS trademark, including symbols, logos, or icons, except pursuant to an express written trademark license from 3B NEXUS.

10. 3B NEXUS’ Trade Dress: You may not imitate the distinctive 3B NEXUS branding, web site design, logos, or typefaces.

11. Slogans and Taglines: You may not use or imitate a 3B NEXUS slogan or tagline.

For example: “Your Markets, Your Business, on Video.” “See, Hear, Know”

12. Domain Names: You may not use an identical or virtually identical 3B NEXUS trademark as a second level domain name.

The 3B NEXUS Trademarks

13. You may not use the Bulls Bears & Butterflies trademark standing alone except to denote or refer to 3B NEXUS’ product lines.

14. You may use “3B NEXUS” or “Bulls Bears & Butterflies” in your product name, company name, trade name, or service name provided your name satisfies the following criteria:

Your product is not:

14.1 Recorded media, computer software; software downloadable from the Internet; downloadable electronic publications; compact discs; digital music; telecommunications apparatus; computer games equipment; transmission or reproduction of sound or images; recording discs.

14.2 Paper, cardboard and goods made from these materials; printed matter; books; journals; magazines; photographs; stationery; artists' materials; typewriters packaging materials; printers' type; printing blocks; printed publications.

14.3 Advertising; electronic data storage; advertising services provided via the Internet; advertising services provided via Internet video; provision of business information via Internet video; financial marketing.

14.4 Internet chat room services; portal services; e-mail services; providing user access to the Internet; Internet video broadcasting; electronic data transfer; video data streaming; communication via Internet video; communication of financial information.

14.5 Education; providing of training; entertainment; on-line entertainment; sporting and cultural activities; lottery services; electronic games services provided by means of the Internet; the provision of on-line electronic publications.

14.6 Your name does not suggest a false association with 3B NEXUS.

14.7 Your name is not confusingly similar to any trademark owned or used by 3B NEXUS.

14.8 You acknowledge that 3B NEXUS is the sole owner of the “Bulls Bears & Butterflies” trademark and that you will not interfere with 3B NEXUS’ use or registration of the mark alone or in combination with other words.

14.9 If you are a 3B NEXUS authorized reseller, distributor, agent or member of a 3B NEXUS program, you may be subject to additional restrictions.

Rules for Proper Use of 3B NEXUS Trademarks

15. Trademarks are adjectives used to modify nouns; the noun is the generic name of a product or service. As adjectives, trademarks may not be used in the plural or possessive form.

16. An appropriate generic term must appear after the trademark the first time it appears in a printed piece, and as often as is reasonable after that. Suggested generic terms are provided in the 3B NEXUS Trademark List in Schedule A of this guideline.

17. Always spell and capitalize 3B NEXUS’ trademarks exactly as they are shown in the 3B NEXUS Trademark List in Schedule A of this guideline. Do not shorten or abbreviate 3B NEXUS product names. Do not make up names that contain 3B NEXUS trademarks.

Proper Trademark Notice and Attribution

18. On product, product documentation, or other product communications, use the appropriate trademark symbol (TM, ®) the first time the 3B NEXUS trademark appears in the text of the advertisement, brochure, or other material.

19. Refer to the 3B NEXUS Trademark List in Schedule A of this guideline for the correct trademark symbol, spelling of the trademark, and generic term to use with the trademark. Generally, the symbol appears at the right shoulder of the trademark (except the 3B NEXUS Logo, where the logo appears at the right foot).

20. Include an attribution of 3B NEXUS’ ownership of its trademarks within the credit notice section of your product, product documentation, or other product communication.

The following are the correct formats including international credit notices:

3B PLATFORM and 3B PORTAL are trademarks of 3B NEXUS Limited.

3B LIVE is a trademark of 3B NEXUS Limited, registered in England and other countries.

Depictions of 3B NEXUS Products

21. Endorsement or Sponsorship: 3B NEXUS does not support the use of its logos, company names, product names, or images of 3B NEXUS products by other parties in marketing, promotional or advertising materials as their use may create the perception that 3B NEXUS endorses or sponsors the product, service or promotion.

22. Compatibility: If you are a developer, you may show an image of a 3B NEXUS product in your promotional/advertising materials to depict that your product is compatible with, or otherwise works with, the 3B NEXUS product or technology, provided you comply with the following requirements:

22.1 Your product is in fact compatible with, or otherwise works with, the referenced 3B NEXUS product.

22.2 The image is an actual photograph of the genuine 3B NEXUS product and not an artist’s rendering (Note: You must obtain express written permission from 3B NEXUS before using any photograph owned or licensed by 3B NEXUS).

22.3 The 3B NEXUS product is shown only in the best light, in a manner or context that reflects favourably on the 3B NEXUS products and on 3B NEXUS Limited.

22.4 The reference to 3B NEXUS does not create a sense of endorsement or sponsorship by, or other false association with, 3B NEXUS or 3B NEXUS products.

SCHEDULE A

3B NEXUS Trademark List

The following is a list of the 3B NEXUS’ trademarks and service marks.

When using the marks in any distribution including international distribution, include the appropriate TM or ® symbol on first use. Use the appropriate trademark attribution notice, for example: 3B PLATFORM^TM is a trademark of 3B NEXUS Limited, registered in England and other countries.

The list also includes one or more suggested generic terms for each trademark. For all publications, include an appropriate generic term after the trademark the first time it appears. Thereafter, the generic term should appear frequently with the trademark. (Note: These generic terms are only suggestions, and there may be other words that are equally appropriate).

Remember that trademarks are adjectives, and cannot be made plural or possessive.

The absence of a product or service name or logo from this list does not constitute a waiver of 3B NEXUS’ trademark or other intellectual property rights concerning that name or logo.

Other 3B NEXUS Product or Service Names

If a product or service name is not listed under 3B NEXUS’ Trademarks, Tradenames or Service Marks, it should not be followed by a ™ or ® notation and should not be included in credit lines. All 3B NEXUS’ trademarks need to be given the correct attribution in the credit section of all publications including international publications.
